1. About These Terms

These Terms & Conditions ("Terms") govern your use of the website operated by Baby Angels Childcare Centre Sdn. Bhd. ("Baby Angels", "we", "our", "us") and your engagement with our care services.

By using our website, our app, or our care services, you agree to these Terms. If you do not agree, please do not use our website or services.

You may use our website to learn about our care services, inquire about availability and partnership opportunities, and contact us.

You may not:

• Use our website for any unlawful purpose
• Copy, modify, or distribute our content without our written permission
• Attempt to gain unauthorised access to our systems, our app, or other users' accounts
• Submit false or misleading information through our forms
• Use automated tools to scrape or harvest information from our site

4. Care Services

Our care services are provided to babies aged 1 to 18 months, subject to availability and successful enrolment.

All care arrangements are confirmed through a private consultation. The specific terms of your care plan, including services included, schedule, duration, and fees, will be set out in a separate Care Agreement signed by both parties.

These Terms apply alongside any Care Agreement. In the event of conflict between these Terms and your Care Agreement, the Care Agreement prevails for that specific care arrangement.

5. Booking, Deposit, and Payment

Inquiries submitted through our website or app do not constitute a confirmed booking.

A confirmed booking requires:

• Successful enrolment screening
• A signed Care Agreement
• Deposit payment as specified in your Care Agreement

Full payment terms, refund eligibility, and cancellation conditions are set out in your individual Care Agreement.

6. Health and Medical Information

Parents and guardians must disclose all relevant medical conditions, allergies, vaccinations, and special needs of their baby before enrolment.

We rely on the accuracy of the information you provide. Withholding material information may result in termination of the Care Agreement.

In the event of a medical emergency involving your baby, we will:

• Provide immediate first aid through our trained staff
• Contact you and any emergency contacts you have provided
• Engage our partner medical facilities as needed
• Seek emergency medical treatment for your baby if you cannot be reached

By enrolling, you authorise us to seek such emergency medical care when it is in the best interest of your baby.

7. Code of Conduct

To maintain a safe and respectful environment, parents, guardians, and authorised visitors agree to:

• Treat our staff and other families with respect
• Follow our facility access protocols at all times
• Respect the privacy of other families and their babies
• Refrain from photography or recording inside the facility, except of your own baby and with our awareness
• Not enter areas designated for staff or other families

We reserve the right to refuse entry or terminate services for breaches of this code.

8. Photography, Media, and Marketing

We may take photographs or video of your baby in the course of our care, which are shared with you privately through our app.

We will not use any image or video of your baby for marketing, social media, or any public-facing material without your separate written consent.

You may revoke any marketing consent at any time by writing to info@babyangels.com.my.

9. Companion App

If you use our companion mobile app, you agree to:

• Keep your login credentials confidential and not share them with unauthorised persons
• Accept that the app may be updated or temporarily unavailable during maintenance
• Use the app only for its intended purpose of monitoring your own baby's care

We are not liable for unauthorised use of your account arising from your failure to safeguard your credentials.

10. Intellectual Property

All content on our website, our app, and our marketing materials, including text, images, logos, design elements, and software, is the property of Baby Angels Childcare Centre Sdn. Bhd. or our licensors.

You may not reproduce, distribute, or create derivative works of our content without our written permission.

11. Third-Party Partners

We work with partner clinics, brands, and service providers. Linking to their websites or referencing their services on our site does not constitute endorsement of their products or services outside of our specific partnership arrangement. Your relationship with any third party is between you and that party.

12. Limitation of Liability

We provide our services with reasonable skill, care, and diligence in line with industry standards for premium infant care.

Subject to applicable law, our total liability for any claim arising from our services is limited to the fees you have paid us for the affected month of service.

We are not liable for:

• Indirect, consequential, or incidental loss
• Loss of business, revenue, or opportunity
• Events outside our reasonable control (see Force Majeure)

Nothing in these Terms limits our liability for personal injury, death caused by our negligence, or any liability that cannot lawfully be excluded under Malaysian law.

13. Termination

We may terminate your Care Agreement immediately if:

• Information you provided was materially false or misleading
• You fail to make payments as agreed
• You or any authorised visitor breach our Code of Conduct
• Continued care poses a risk to your baby, other babies, or our staff

You may terminate your Care Agreement in accordance with the notice period and conditions set out in that agreement.

14. Force Majeure

We are not liable for failures or delays caused by events outside our reasonable control, including natural disasters, public health emergencies, government action, utility failures, or facility infrastructure failures.

15. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top will reflect any changes. Continued use of our website or services after we publish updated Terms means you accept the changes.

16. Governing Law and Disputes

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or our services will be subject to the exclusive jurisdiction of the Malaysian courts.
